1. Definitions

(unchanged from the cleaned version, included here for completeness)

  • ACL means the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth).
  • Agreement means this Membership Agreement including the Details, Important Notice and these Terms.
  • Approved Club means a VibeZ Club approved to offer memberships to persons aged 12–17.
  • Biller means our third-party billing provider (currently Ezidebit).
  • Club means a VibeZ 24/7 Fitness club.
  • Club Rules means the rules displayed in the Club and amended from time to time.
  • Details means the membership details agreed at sign-up.
  • Facilities and Services includes all gym facilities, equipment, classes and amenities provided by VibeZ.
  • Fees means all fees payable under this Agreement.
  • Fob Key means the access device issued to Members.
  • Member means a person with an active Membership.
  • Membership means your agreement to access VibeZ under these Terms.
  • Minimum Age means 12 years.
  • Minimum Term means the minimum contract period set out in the Details.
  • Ongoing Agreement means a Membership continuing after the Minimum Term.
  • Promotional Membership means any discounted or special-rate Membership including Mates Rates, Concession, Senior or Referral offers.
  • Staffed Hours means the times staff are present at the Club.
  • Written Notice means notice provided in writing (email, post or in-club form).

2. Joining & Access

  • You must provide accurate personal details and photo identification when joining.
  • Eligibility evidence is required for any promotional or discounted Membership.
  • A Fob Key is required for Club access and must not be shared.

3. Cooling-Off Period

You may cancel your Membership within 10 days of the Start Date by written notice. On cancellation during cooling-off:

  • Fob Key Fee and used services are payable

  • Joining and unused Membership Fees are refunded

4. Age & Minors

  • Minimum age is 12 years.
  • Members under 18 require parent/guardian consent and in-club sign-up.
  • Minors must comply with the Membership Age Policy and Special Conditions for 12–17 Year Olds.

5. Health, Safety & Conduct

Members must:

  • Ensure they are medically fit to exercise
  • Complete required health screening
  • Use equipment correctly
  • Follow Club Rules and staff directions

VibeZ may suspend or cancel Memberships for safety breaches or misconduct.

6. Access, Secuity & Emergencies

  • Tailgating, sharing access or misuse of emergency equipment is prohibited.
  • Replacement Fob Fees apply if lost or damaged.
  • Surveillance (video/audio) is used for safety in common areas only.

7. Privacy

8. Ending Your Membership During the Minimum Term

Medical cancellation requires written medical confirmation.

Convenience cancellations incur a Cancellation Fee. No Cancellation Fee applies if:

  • We breach an Essential Term

  • Agreement changes adversely affect you

  • You have rights under consumer law

9. Membership Freeze

  • Up to 2 freezes per year, max 6 months total.
  • Longer freezes may be approved for medical or hardship reasons.
  • Freeze time extends the Minimum Term.

10. Cancellation After Minimum Term

  • Fixed Term Memberships end automatically.
  • Ongoing Memberships require 14 days’ written notice.

11. When Vibez May Cancel

VibeZ may cancel Memberships for:

  • Non-payment

  • Serious breaches

  • Bankruptcy or insolvency

Outstanding fees remain payable.

12. Release & Indemnity

Members acknowledge inherent risks in gym use. Liability is limited to the extent permitted by law, excluding reckless conduct.

13. Fees

Joining Fee: Non-refundable

Pro-Rata Fees: Applied when joining mid-billing period.

Fob Key Fee: Replacement fees apply if lost/damaged.

Membership Fees: Paid fortnightly by direct debit unless otherwise stated.

 Cancellation Fee: Applies for convenience cancellations during the Minimum Term.

Missed Payments: May result in suspension, fees accruing, or termination.

Fee Increases: No Membership Fee increases during Minimum Term (except transfers).
Fees may increase after Minimum Term with notice.

Promotional Memberships, Discounts & Referrals

Mates Rates: 2 or more people must join within 7 days. If eligibility changes, standard rates may apply

Concession / Senior Memberships: Valid concession or senior ID must be presented. Rates may revert if eligibility ceases

Upfront Fees: Joining Fees, Fob Fees and Pro-Rata Fees may apply unless stated otherwise

Referral Gift Cards:

  • Available only on Fortnightly Direct Debit Memberships
  • Issued within 4 weeks
  • Not valid for Fitness Passport or PIA Memberships. Subject to eligibility and active membership status

14. Payments

Payments are processed via direct debit unless otherwise agreed. Dishonour and administration fees may apply.

15. Third-Party Services

Personal training and other services may be provided by third parties and are subject to separate terms.

16. Changes to Terms

VibeZ may update these Terms with reasonable notice. Members may cancel if adversely affected.

17. Liability & Property

Members are responsible for personal property and damage they cause.

18. Club Closures

Short-term closures may occur. Extended closures may result in freezes or alternative Club access.

19. Complaints

Complaints should first be raised with staff, then emailed to: info@vibezfitness.com.au

20. General

NSW law applies. Invalid clauses do not affect the remainder of the Agreement.
